Harris, the Supreme Court struck down a California law that combined food safety and animal welfare considerations. The law required all non-ambulatory pigs to be euthanized immediately and kept out of the food chain. It was supported by the Humane Society, and challenged by the National Meat Association. The Supreme Court concluded that the California law is preempted by the Federal Meat Inspection Act (FMIA) and the federal Humane Meat Slaughter Act. The FMIA contains a broad preemption clause, which the unanimous Court interpreted to apply to pre- and post-mortem operations. The California prohibition on sales of the pig meat is also preempted. The Court said, "...the FMIA addresses not just food safety, but humane treatment as well. ...The FMIA regulates slaughterhouses' handling and treatment of non-ambulatory pigs from the moment of their delivery through the end of the meat production process."
